§ 6-13. Animal traps.

  • (a)

    The animal services division shall maintain an inventory of various-sized live animal traps, which may be made available to the citizens of Newport News. The director of parks, recreation and tourism shall set a deposit and usage fee for the use of any animal trap.

    (b)

    When a trap is destroyed, lost or damaged, those persons responsible for the trap shall reimburse the city for the full cost of the repair or replacement of the trap.

    (c)

    Prior to utilizing any trap set for the capture of any wild or fur bearing animal, the person acquiring such trap must first present any required permit issued by the Virginia Department of Game and Inland Fisheries pursuant to Virginia Code, § 29-300.1, as amended.

    (d)

    No person may interfere with the lawful use of an animal trap. Tampering shall include, releasing any animal contained therein, damaging or otherwise preventing proper operation of the trap, and removal/relocation of the trap. This subsection will not apply to the animal control officer, the director of public health or his designee, any city employee dealing with a trap placed upon city property without the consent of the city, or a state or federal game warden.
