§ 45-522. Family home child care facility.

  • (a)

    Family home child care facility means a private family dwelling of a person or persons who maintain the dwelling and regularly provide direct care on the premises during part of a twenty-four-day to not more than four (4) children under the age of twelve (12), excluding the provider's own children or grandchildren related by blood, marriage or adoption and foster children.

    (b)

    A family home child care facility in a dwelling unit shall be permitted by right in all residential zoning districts.

    (c)

    No employees, whether paid or unpaid, except persons who use the dwelling as their primary residence, shall be involved in the family home child care facility.

    (d)

    Upon violation of any part of this section, the zoning administrator shall take necessary action to remedy such violations as provided for in the City Code.

    (e)

    The city council shall not consider applications for conditional use permits, pursuant to Article XXVII for modifications to the provisions contained in this section.
